MIDMI.NET Acceptable Use Policy
- All of the provisions of MIDMI.NET. service agreement (hereinafter referred to as "Agreement") shall apply to the User's
Principal Account and Associate Accounts billed to the Principal Account. (Account holder named below herein referred to here as "User".)
- The rights of access conveyed by this Agreement are non-transferable. Use of a MIDMI.NET account is expressly limited to the
individual or dependents whose names appear on the personal account; for business accounts, the names of the employees whose names appear on the application.
- The User agrees to use this service in a manner consistent with any and all applicable laws, whether state, federal or by
international treaty.
- The User agrees to follow the Acceptable Use Policy of any network User connects to, including MIDMI.NET's system.
- If User is less than eighteen (18) years of age, this agreement must be signed by his/her parent or legal guardian who assumes
responsibility for all charges related to use of User's account(s).
- The use of MIDMI.NET for advertising or promotion of a commercial product or service without the express, written consent of
MIDMI.NET is prohibited. Violators are subject to immediate termination of their account. Contact us should you wish to do any advertising.
- The User is responsible for all use of User's account(s) and confidentiality of password(s). MIDMI.NET will suspend access or change
access to User's account(s) within twenty four (24) hours or less after notification by User that his/her password has been lost, stolen or otherwise compromised.
- The User is responsible for any and all local or long-distance telephone charges for connecting to MIDMI.NET
- The User agrees to give thirty (30) days written notice to MIDMI.NET in order to cancel account. All outstanding balances will still
be due.
- The User agrees to pay MIDMI.NET for any and all charges relating to the use of User's account(s) according to rates and prices
published on-line at the time the service is used. However, on-line
rates and prices are incorporated into this Agreement by reference. User is also responsible for any monthly storage charges as described on-line.
- Access is subject to credit limits established by the issuer of User's credit card and by MIDMI.NET A credit limit is applied to all
accounts. User's access to service may be suspended if User exceeds his/her credit limit unless prior arrangements have been made.
- The User is responsible for charges at the time the service is used and MIDMI.NET may apply the amount due to User's credit card at
any time. The charges typically will be monthly, unless the User's credit limit is reached.
- MIDMI.NET reserves the right to change prices on thirty (30) days notice published on-line.
- MIDMI.NET reserves the right to suspend access to service for User's account(s) upon an indication of credit problem, including
delinquent payments or rejection of any credit card charges.
- THE MIDMI.NET SERVICE IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT
NOT LIMITED TO, THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE ARE MADE WITH RESPECT TO MIDMI.NET AND/OR TCSS, INC. OR ANY INFORMATION OR SOFTWARE THEREIN. THIS "NO WARRANTY" EXPRESSLY INCLUDES ANY REIMBURSEMENT FOR LOSSES OF INCOME DUE TO DISRUPTION OF SERVICE BY MIDMI.NET OR TCSS, INC. OR ITS PROVIDERS.
- Neither MIDMI.NET nor its Information Providers are responsible for any damages arising from User's use of MIDMI.NET or by User's
inability to use MIDMI.NET service.
- MIDMI.NET reserves the right to change without notice the MIDMI.NET service, including, but not limited to, access procedures, hours
of operation, menu structures, commands, documentation, vendors and services offered.
- MIDMI.NET is not responsible for User's personal files residing on MIDMI.NET equipment. User is responsible for independent backup of
data stored at MIDMI.NET
- MIDMI.NET reserves the right to delete User's personal files after one or both parties terminates agreement.
- MIDMI.NET reserves the right, at its sole discretion, to delete any information entered into MIDMI.NET by User. MIDMI.NET and its
authorized representatives shall have the right, but shall not be obligated, to edit publicly viewable information.
- THE USER HEREBY AGREES THAT ANY MATERIAL SUBMITTED FOR PUBLICATION OR STORAGE ON MIDMI.NET'S EQUIPMENT THROUGH USER'S ACCOUNT(S) DOES
NOT VIOLATE OR INFRINGE ANY COPYRIGHT, TRADEMARK, PATENT, STATUTORY, COMMON LAW OR PROPRIETARY RIGHTS OF OTHERS, OR CONTAIN ANYTHING OBSCENE OR LIBELOUS.
- MIDMI.NET at its sole business judgment, may terminate this membership Agreement immediately or suspend User's access to the service
upon any breach of this membership Agreement by User, including,
but not limited to, refusal or failure to pay for services provided or by sole judgment of MIDMI.NET that User may be performing activities harmful to MIDMI.NET or its Users, employees, vendors, business relationships or any other users of the Internet.
- Due to the public nature of the Internet, all electronic mail is considered publicly accessible and important information should be
treated carefully. MIDMI.NET is not liable for protection or privacy of electronic mail and information transferred through the Internet.
- MIDMI.NET reserves the right to limit access to service for any User account which has been inactive for six (6) months. Reactivation
will be done at User's request, providing User's account is current in fees due.
- Use of any distribution lists in electronic mail or other mass electronic mailings is subject to approval by MIDMI.NET for each
individual use.
- This Agreement shall be governed by the laws of the State of Michigan.
- MIDMI.NET may modify these terms and conditions upon notice published on-line via MIDMI.NET User's use of MIDMI.NET services after
such notice shall constitute User's acceptance of the modifications to this Agreement.
- Non-enforcement of any section of this Agreement does not constitute consent and MIDMI.NET reserves the right to enforce this
Agreement at its sole discretion.
- If any one or more paragraphs in this Agreement is found to be unenforceable or invalid, User's and MIDMI.NET's agreement on all
other paragraphs shall remain valid.
- User understands that MIDMI.NET acts as a gateway in providing access to the Internet and is not responsible for content
